Accident At Work
A 50 year old man sustained a Back Injury at work and has suffered from an acceleration of a pre-existing back condition and psychological symptoms as a result of the accident. The accident happened when the claimant, who was working for the defendant at an oil refinery, fell through a rotten step in a port cabin on the oil refinery, and he fell against a handrail sustaining injury. The claimant brought an action against the defendant alleging that it was negligent in the health and safety duties it owed to its employees.
Medical evidence provided to the court showed there was an acceleration of a pre-existing back condition and also psychological symptoms from the accident. The man received £63,000 for the back injuries.
